일본의 안보형사법제에 대한 검토 = A Study on the Japans Security Criminal Law

다국어 초록 (Multilingual Abstract)

Japan``s Security Criminal Law governed the threat to national security and public safety by Criminal Law; The Subversive Activities Prevention Law, The Self-Defense Forces Law, The Wireless Telegraphy Act, Treaty of Mutual Cooperation and Security between the United States and Japan, ETC instead of adopting a comprehensive special law. Also, the Subversive Activities Prevention Law similar to Korea``s National Security Law out of Special Law of Criminal. However, this law among dissident activities rather than repressing the freedom of thought and ideas that act as subversive activities a system that denies the move is the only provisions for penalties. This point differed from Korea``s National Security Law. In addition, as with Korea``s National Security Law from the time of enactment that violates fundamental human rights and the abolitionism had been raised continued. An understanding of Japan``s security criminal law implicates to our country security in light of security criminal law out of society``s need to respond quickly to changes in criminal law system. Indeed, The legislation of Anti-Terrorism Law is necessary in our country aside of Japan``s security criminal law related legislation.
