    학교용지부담금의 부과요건, 제외사유, 면제사유를 정한 법률조항에 관하여 수차례 위헌결정이 있었고, 개선입법을 통해 부분적으로 정비가 되었지만 여전히 세부적인 기준들은 부족하거나 미비하다. 헌법재판소는 대상 결정에서 법원이 부담금의 헌법적 요건을 바탕으로 행정청의 학교용지부담금 산정에 관한 재량권 행사를 합헌적 범위 내에서 통제할 수 있음을 전제로 합헌 결정을 하였다. 그런데 대법원이 대상 판결에서 제시하는 엄격해석원칙과 재량통제 기준에 관한 일반적 법리만으로는 학교용지법의 불완전한 규정을 해석하고 행정청이 합헌적인 범위에서 재량권을 행사하도록 통제하는 데 어려움이 있을 수 있다. 행정청이 부담금의 부과 여부, 산정기준, 면제 여부 등에서 가지는 재량권의 범위를 확정하고 합헌적 범위 내에서 재량권을 행사하도록 통제함에 있어 체계적·헌법합치적 법률해석이 동원될 필요가 크다.

    The statutory provisions governing the imposition requirements, exclusion grounds, and exemption grounds for school site charges have been declared unconstitutional on several occasions. Although subsequent legislative amendments have partially remedied these defects, significant gaps and ambiguities remain in the detailed standards governing the system. In the constitutional decision under this review, the Constitutional Court upheld the relevant provisions on the premise that courts are capable of reviewing and controlling administrative discretion in calculating school site charges based on the constitutional requirements applicable to charges. The general legal principles concerning the rule of strict interpretation and judicial control of administrative discretion articulated by the Supreme Court in the case under this review may be insufficient to interpret the incomplete provisions of the School Sites Act and to ensure that administrative authorities exercise their discretion within constitutionally permissible limits. In determining the scope of administrative discretion regarding the imposition, calculation, and exemption of school site charges and ensuring that such discretion is exercised within constitutional boundaries, there is a substantial need for systematic and constitutionally conforming statutory interpretation.
    In the decision under this review, the Supreme Court held that, with respect to the standards for calculating school site charges, the rule of strict interpretation does not permit a restrictive interpretation limiting the relevant number of households to only those additionally generated by a development project, nor does it allow the analogical application of provisions excluding certain development projects from the scope of the charge. However, given that the rule of strict interpretation was primarily developed to prevent disadvantageous analogical application of legal provisions against regulated parties, it is questionable whether the same principle should be invoked to reject restrictive interpretations of burdensome provisions or analogical application of favorable provisions.
    It is also doubtful whether such reliance on the rule of strict interpretation provides a sufficiently persuasive justification for rejecting the arguments advanced by the parties. At the same time, the constitutional requirement that school site charges be justified by the necessity of securing educational facilities should be regarded as an implicit requirement for imposition, a substantive standard for calculation, and a hidden ground for exemption, thereby necessitating a systematic and constitutionally consistent interpretation of the School Sites Act.
    With respect to determining the number of households as the basis for calculating school site charges, reliance solely on the general doctrine of abuse or deviation of administrative discretion, as adopted by the Supreme Court, may create a risk of arbitrary assessments or calculations exceeding the constitutional limits applicable to charges. Accordingly, the increase in the number of households attributable to a development project should serve as the principal standard for calculating school site charges, while any additional increase in school enrollment demand exceeding that figure should be specifically demonstrated by the administrative authority through objective evidence. Furthermore, the factor identified by the Supreme Court as relevant to the exercise of calculation discretion—namely, “changes in social perceptions of educational environments and educational policies”—is difficult to reconcile with the statutory provision that designates the “number of households” as the calculation standard. Since such changes are not caused by the development project itself, their appropriateness as a consideration in calculating school site charges warrants reconsideration.
