    현대 사회의 재난 대응에서 민간인 구호자의 자발적 활동은 공공 행정력을 보완하는 핵심적 축을형성하고 있음에도 불구하고, 이들에 대한 법적 예우와 지속적인 지원 체계는 여전히 미흡한 실정이다.
    현행 법제상 민법은 긴급사무관리와 긴급피난 규정을 통해 구호 활동 중 발생한 손해에 대한 배상 책임을 면제하거나 위법성을 조각하고 있으며, 응급의료에 관한 법률의 ‘선한 사마리아인’ 조항은 고의나 중과실 없는 응급처치에 대한 민·형사책임을 감면하고 있다. 또한 재난 및 안전관리 기본법은 구조 활동 참여자에 대한 치료비와 보상금 지급 근거를 명시하고 있고 개별 참사에 관한 4ㆍ16세월호참사 피해구제 및 지원 등을 위한 특별법과 10ㆍ29이태원참사 피해자 권리보장과 진상규명 및 재발방지를 위한 특별법도 제정되어 시행되고 있다. 특히 이태원참사 진상규명법은 민간인구호자를 피해자 범주에 포함하여 트라우마 센터 설치, 의료비 및 생활지원금 지급 등 구체적인 재정적·심리적 지원책을 마련하여 재난의 사후적 치유를 도모하고 있어 진일보된 측면이 있다.

    Under the current legal framework, the Civil Act exempts liability for damages incurredduring rescue activities or excludes illegality through provisions on emergency businessmanagement and necessity. The “Good Samaritan” clause of the Emergency MedicalService Act reduces civil and criminal liability for emergency treatment rendered withoutgross negligence or willful misconduct. The Framework Act on Disaster and SafetyManagement provides a legal basis for covering medical expenses and compensation forthose who participate in rescue operations. Special legislation has also been enacted and isin force, including the Special Act on Relief and Support for Victims of the April 16 SewolFerry Disaster and the Special Act on Guaranteeing the Rights of Victims of the October 29Itaewon Disaster, Truth-Finding, and Prevention of Recurrence. Notably, the ItaewonDisaster Truth-Finding Act represents a significant step forward, as it includes civilianrescuers within the category of victims and establishes concrete financial and psychologicalsupport measures-such as the establishment of trauma centers and the provision ofmedical and living expense subsidies-thereby promoting post-disaster recovery.
