    본 연구는 세계화와 다문화 현상이 심화되는 현대 한국사회의 시대적 요구에 부응하여, 기존의 혈통주의에 기반한 법체계 속 ‘국가’와 ‘국민’ 개념을 비판적으로 성찰하고 포용적 공동체 형성을 위한 법적, 철학적, 사회학적 재해석을 시도한다. 현행 법질서는 외국인을 시혜적 보호의 대상으로 간주할 뿐, 동등한 사회구성원으로 인정하는 데 한계를 보인다. 특히 제헌당시의 역사적 맥락에서 채택된 혈통중심의 ‘국민’ 개념은, 오늘날 급증하는 이주민과 재외동포를 포용하지 못하며 사회통합에 있어 중대한 도전 과제가 되고 있다.
    본 연구는 다학제적 접근을 통해 국가와 국민 개념을 재정립함으로써, 국적 여부를 떠나 모든 사회구성원의 존엄과 가치를 보장하는 포용적 공동체의 실현을 위한 법적 토대를 마련하는 데 목적을 둔다. 이를 위해 다음의 핵심 논점을 제시한다. 우선, 국가는 단순히 ‘폭력을 독점’하는 통치기구가 아니라, 헌법에 명시된 국민의 자유와 권리보장, 법치주의, 민주주의 원리를 핵심 가치로 삼는 이상적 공동체로 이해되어야 한다. 국가의 존재 이유는 헌법적 가치의 실현에 있다.

    This study critically reflects on the concepts of ‘state’ and ‘citizen’ in the existing legal system based on bloodline principle in response to the demands of the times in modern Korean society where globalization and multiculturalism are deepening, and attempts to reinterpret them legally, philosophically, and sociologically for the formation of an inclusive community. The current legal order only regards foreigners as objects of preferential protection, and shows limitations in recognizing them as equal members of society. In particular, the concept of ‘citizen’ centered on bloodline, which was adopted in the historical context at the time of the Constitution, fails to embrace the rapidly increasing number of immigrants and overseas Koreans today, and poses serious challenges to social integration. This study aims to establish a legal-philosophical foundation for an inclusive community that guarantees the dignity and value of all members of society regardless of nationality by redefining the concepts of state and citizen through a multidisciplinary approach. To this end, the following key arguments are presented. First, the state should not be understood as a governing body that simply ‘monopolizes violence’, but as an ideal community that values the freedom and rights of the people, the rule of law, and the principles of democracy as stated in the Constitution. The reason for the existence of the state lies in the realization of constitutional values.
    Based on universal human rights provisions such as “human dignity and value” in the preamble of the Constitution, an interpretive foundation should be established that expands the category of ‘citizens’ beyond natural persons with nationality to ‘all members of society’. It is urgent to move away from the concept of bloodline and shift to the concept of ‘citizen’ based on participation and rights in the community. By citing T.H. Marshall’s theory of citizenship, we should recognize universal rights and obligations as members of the community regardless of nationality, and use it as a link to grant subjectivity, including political fundamental rights, to foreigners who have a base in the country, such as permanent residents.
    As Rawls’s theory of justice and Honneth’s theory of recognition suggest, social recognition and promotion of cultural acceptance of minority groups beyond the granting of legal rights are essential. Like E. Ehrlich’s concept of ‘living law’, effective integration policies should be established by understanding and interacting with the norms within the minority (‘the other’) that the official national law overlooks. In conclusion, this study emphasizes that the Republic of Korea should move away from a closed identity centered on blood relations and move toward an open and expanded civic community based on ‘empathy for place’ and ‘wounds and emotional bonds’. To this end, it is argued that it is an urgent task of the times to build an inclusive legal culture that realizes the spirit of the Constitution through not only legal revision but also strengthening legal education, fostering civic awareness, and creating a human rights-friendly judicial culture.
