    본 연구는 중국과 한국의 전자상거래 및 크로스보더 전자상거래(Cross-border E-Commerce, CBEC) 규제 체계를 비교·분석하여, 규제 철학과 집행 방식의 차이가 시장 구조와 기업 행위에 어떠한 영향을 미치는지를 규명하는 것을 목적으로 한다. 디지털 기술 발전과 플랫폼 경제 확산으로 전자상거래가 글로벌 무역 질서의 핵심 영역으로 부상한 가운데, 각국의 규제 강화는 기업의 국경 간 거래 비용과 법적 불확실성을 증대시키고 있다. 그러나 기존 연구는 주로 법령 조문 중심의 비교에 머물러 규제가 실제로 작동하는 방식과 시장에서 발휘하는 실질적 영향력을 충분히 설명하지 못하였다.
    이에 본 연구는 중국과 한국의 전자상거래 규제를 ① 규제 철학(Regulatory Philosophy), ② 규제 집행 방식과 실효성(Enforcement Mechanism), ③ 기업 행위에 대한 규제 위력(Regulatory Power)이라는 분석 틀을 통해 비교하였다. 연구 방법으로는 법령·정책 문헌 분석과 비교법적 접근을 중심으로 한 질적 연구를 활용하였다.
    분석 결과, 중국은 국가안보와 데이터 주권을 핵심 가치로 삼아 플랫폼을 거래 질서의 관리 주체로 위치시키는 국가 주도형·사전 규제 모델을 채택하고 있는 반면, 한국은 소비자 보호와 공정 경쟁을 중심으로 한 법제 기반의 사후 규제 모델을 유지하고 있음을 확인하였다. 이러한 규제 구조의 차이는 크로스보더 전자상거래에서 기업의 시장 진입 방식, 데이터 처리 전략, 플랫폼 의존도에 구조적인 영향을 미치는 것으로 나타났다. 본 연구는 전자상거래 규제를 ‘규제 종속적 거래 구조’로 개념화함으로써 디지털 무역과 규제 연구의 분석 범위를 확장하고, 향후 국제 전자상거래 규제 정합성 논의에 정책적 시사점을 제공한다.

    The purpose of this study is to compare and analyze the regulatory framework of cross-border E-commerce (CBEC) between China and Korea to find out how differences in regulatory philosophy and enforcement methods affect market structure and corporate behavior. With e-commerce emerging as a key area of the global trade order due to the development of digital technology and the spread of the platform economy, strengthening regulations in each country is increasing the cost and legal uncertainty of cross-border transactions for companies. However, existing studies have not sufficiently explained how regulations actually work and their practical impact on the market, mainly by comparing laws and regulations.
    Therefore, this study compared the regulations of e-commerce in China and Korea through the analysis framework of ① Regulatory Philosophy, ② Regulatory Mechanism, and ③ Regulatory Power for Business Behavior. As a research method, qualitative research focusing on the analysis of legal and policy literature and a comparative approach was used.
    As a result of the analysis, it was confirmed that China adopts a state-led and pre-regulatory model in which the platform is positioned as the management entity of the transaction order with national security and data sovereignty as its core values, while Korea maintains a legal system-based post-regulatory model centered on consumer protection and fair competition. These differences in regulatory structure were found to have a structural impact on a company's market entry method, data processing strategy, and platform dependence in cross-border e-commerce. This study expands the scope of analysis of digital trade and regulatory research by conceptualizing e-commerce regulation as a 'regulatory dependent transaction structure' and provides policy implications for future discussions on the consistency of international e-commerce regulations.
