    2026. 3. 12. 재판소원이 도입되었다. 재판소원이 도입되기 전 헌재는 재판을 거친 공권력 행사에 대한 헌법소원을 부적법하다고 보았다. 재판소원 금지의 취지, 헌법 제107조 제2항, 기판력을 근거로 들었다.
    재판소원이 도입된 이후에는 기판력만을 이유로 들어 원행정처분에 대한 헌법소원이 부적법하다고 판단하였다. 원행정처분에 대한 재판소원이 허용되지 아니하면, 원행정처분도 취소할 수 없다는 논리다. 그런데 헌재는 2026. 3. 12. 이후 거의 모든 재판소원을 각하하고 있다. 결국 원행정처분에 대한 헌법소원이 본안 심사를 받게 될 가능성은 거의 없게 되었다.

    On March 12, 2026, the constitutional complaint against court judgments was introduced. Before its introduction, the Constitutional Court had regarded constitutional complaints against exercises of public power that had already undergone judicial review as inadmissible. It relied on the purpose of prohibiting constitutional complaints against judgments, Article 107(2) of the Constitution, and the doctrine of res judicata.
    After the introduction of constitutional complaints against judgments, however, the Constitutional Court has held constitutional complaints against the original administrative disposition inadmissible solely on the ground of res judicata. The logic is that, if a constitutional complaint against the judicial decision concerning the original administrative disposition is not permitted, then the original administrative disposition itself likewise cannot be revoked. Yet, since March 12, 2026, the Constitutional Court has dismissed almost all constitutional complaints against judgments. As a result, the possibility that a constitutional complaint against the original administrative disposition will receive a merits review has become nearly nonexistent.
    In constitutional complaints against original administrative dispositions, the court judgment is merely a “remedial procedure” referred to in the proviso to Article 68(1) of the Constitutional Court Act. Once that remedial procedure has been exhausted and a constitutional complaint is filed, there is no room for the res judicata effect of the court judgment to intervene in the discussion. Moreover, res judicata is not some absolute effect that can never be undone. The very existence and validity of retrial procedures demonstrate that res judicata does not possess constitutional force. If res judicata did possess constitutional force, then statutory retrial procedures themselves would be unconstitutional. From a jurisprudential perspective, it is difficult to accept the argument that res judicata, which is merely a legal effect, cannot be nullified through the constitutional complaint procedure established by the Constitutional Court Act. If a constitutional complaint cannot nullify res judicata, then neither could a retrial.
    Even before the introduction of constitutional complaints against judgments, the theory of res judicata could not properly serve as a basis for deeming constitutional complaints against original administrative dispositions inadmissible. Now that constitutional complaints against judgments have been introduced, the res judicata theory has even less room to stand. Final court judgments—judgments that already carry res judicata effect—have themselves become subject to constitutional complaint. In such circumstances, it is difficult in many respects to accept the claim that an original administrative disposition, which is not itself a court judgment but merely an administrative act that has passed through judicial review, cannot become the subject of a constitutional complaint because of res judicata.
