    본 연구는 디지털 기술의 발전에 따라 선거운동의 중심이 전통적 오프라인 공간에서 소셜 미디어 및 동영상 플랫폼으로 이동한 현실을 분석하고, 이에 대응하는 「공직선거법」의 재정립 방향을 모색하는 데 목적이 있다. 현행 법제는 아날로그 매체 중심의 사후적 행위 규제에 머물러 있어, 디지털 환경의 실시간성과 확산성, 알고리즘 편향성을 충분히 반영하지 못하는 한계를 지닌다. 특히 인공지능 기술을 유권자의 정보 접근과 인식 형성에 영향을 미치는 알고리즘 게이트키퍼(Gatekeeper)로 파악하고, 딥페이크 및 지능형 허위 정보가 합리적 의사결정을 왜곡하며, 마이크로 타기팅이 공론장의 분절을 심화시키는 문제를 지적한다. 또한 플랫폼 사업자의 책임 회피와 규제 비대칭성 역시 중요한 구조적 문제로 진단한다. 이에 본 연구는 유럽연합(EU), 독일, 미국의 해외 입법례를 참고하여 선제적 시스템 규제로의 전환, 플랫폼의 위험 관리 및 투명성 의무 부과, 딥페이크에 대한 라벨링 중심 규제, 정치광고 및 선거비용의 실시간 공개 제도 도입, 그리고 거버넌스 및 디지털 리터러시 강화 방안을 제시한다. 이는 기술의 작동 원리를 법체계에 통합함으로써 표현의 자유와 선거의 공정성을 조화시키는 입법적 대안을 제시한다는 점에서 의의를 가진다.

    This study analyzes the shift of election campaigning from traditional offline spaces to social media and video platforms in response to digital advancement, and explores directions for reestablishing the Public Official Election Act. The current legal framework, centered on ex post regulation of individual acts based on analog media, shows clear limitations in addressing the real-time nature, rapid dissemination, and algorithmic bias of the digital environment. It conceptualizes artificial intelligence(AI) as an “algorithmic gatekeeper” that significantly shapes voters’ access to information and political perception. Deepfakes and AI-driven disinformation distort rational decision-making, while micro-targeting exacerbates fragmentation of the public sphere. The study also identifies regulatory asymmetry and the limited accountability of platform operators as key structural challenges. Drawing on comparative analyses of the European Union and Germany, it proposes reforms including a shift toward ex ante systemic regulation, strengthened platform transparency and risk management obligations, labeling-based regulation of deepfakes, real-time disclosure of political advertising and campaign finance, and enhanced governance and digital literacy. Ultimately, the study presents legislative alternatives that harmonize freedom of expression with electoral fairness by incorporating the logic of digital technologies into the legal system.
