생성형 AI 시대 플랫폼 콘텐츠 창작의 저작자성 판단에 관한 소고 -웹소설·웹툰 창작 사례를 중심으로- = A Study on the Determination of Authorship in Platform Content Creation in the Age of Generative AI - Focusing on Cases of Web Novel and Webtoon Creation -

국문 초록 (Abstract)

본고는 생성형 AI 시대 플랫폼 콘텐츠 창작에서 저작자성을 어떻게 판단할 것인가를 검토하는 데 목적이 있다. 연구 대상은 웹소설과 웹툰의 생성형 AI 활용 사례이며, 실제 창작과 유통 과정에서 논란이 어떻게 드러나는지를 살펴보았다.
이를 위하여 저작권법상 저작자 개념과 창작자주의, 플랫폼 기반 콘텐츠 창작의 구조적 특성을 분석하고 연재 웹소설, 웹툰 제작, 웹소설 표지 사례를 통하여 고찰하였다.
그 결과, 인공지능에 독자적 권리를 부여하거나 공표와 유통 과정에서 어떠한 법리를 활용할 것인가에 앞서, 핵심 쟁점은 인간의 실질적 기여를 어떻게 판단하고, 저작자성을 어디에 귀속시킬 것인가에 있음을 확인하였다.
특히 플랫폼 콘텐츠의 경우 독자 수용 반응과 유통 구조가 창작자성 판단에 직접 개입하는 경우가 있어 생성형 AI 활용 문제는 저작권의 문제이면서 동시에 책임과 수용의 문제로 드러난다.

다국어 초록 (Multilingual Abstract)

This study aims to examine how authorship should be determined in platform content creation in the age of generative AI. The cases analyzed are instances of generative AI use in web novels and webtoons, with attention to how controversies emerged in actual processes of creation and distribution.
To this end, the study analyzes the concept of authorship and the principle of creator-based authorship under copyright law, as well as the structural characteristics of platform-based content creation, through cases involving serialized web novels, webtoon production, and web novel cover images.
The findings show that, prior to the question of whether independent rights should be granted to AI or which legal doctrines should be applied in the processes of publication and distribution, the key issue lies in how to assess the extent of human contribution and where authorship should be attributed.
In particular, in platform content, reader response and distribution structure may directly intervene in the judgment of authorship. Thus, the use of generative AI appears not only as a matter of copyright, but also as a matter of responsibility and reception.
