정의(定義)의 정치와 생명공학기술 규제: 유전자변형생물체법의 형성과 제도적 번역 = The Politics of Definition in Biotechnology Regulation: The Formation and Institutional Translation of the LMO Act

국문 초록 (Abstract)

본 연구는 한국 유전자변형생물체(LMO) 법제의 형성과 정의 규정을 분석하여, 법률상 정의가 규제 범위와 정책 논의를 구조화해 온 제도적 효과를 규명한다. 카르타헤나의정 서 이행 과정에서 형성된 LMO 정의는 국제 규범의 단순 수용이 아니라 국내의 제도적 맥락 속에서 번역･재구성된 결과였다. 이러한 정의 구조 속에서 신기술의 규제 논의는 새로운 규제 설계로 나아가기보다 ‘정의에 해당하는지 여부’를 둘러싼 판단 단계에 반복 적으로 머무르는 경향을 보여 왔다. 본 연구는 정의가 기술 규제의 방향과 가능성을 선제 적으로 배치하는 제도적 장치임을 밝히고, 이를 고정된 경계가 아닌 제도적 자원으로 재 검토할 필요성을 제시한다.

This study analyzes the formation of the Living Modified Organisms (LMO) Act and its legal definition in South Korea, identifying how the definition has shaped regulatory scope and structured policy discourse. The LMO definition, established during the implementation of the Cartagena Protocol, was not a simple adoption of international norms but the outcome of “institutional translation” within the domestic institutional context. Under this framework, regulatory debates on emerging biotechnologies have tended to remain at the stage of determining whether they fall within the existing definition, rather than advancing toward alternative regulatory designs. This study argues that legal definitions function as institutional devices that structure the direction and conditions of regulatory debate, thereby shaping the possibilities of technology governance. Accordingly, it suggests that legal definitions should be reconsidered not as fixed boundaries but as dynamic institutional resources subject to ongoing interpretation and adjustment.
