    기후 위기의 상황은 지구 차원에서 모든 영역에 영향을 미치는 점에서 중소기업은 물론 국가의 중소기업 정책에서도 거대한 전환을 요청한다. 특히 헌법에서 중소기업을 보호함을 규정하고 있으므로, 헌법적 관점에서 이 사안을 검토할 필요가 있다. 중소기업과 대기업의 관계 문제는 전통적인 중소기업 정책의 과제인 동시에 기후 위기 대응에서도 매우 중요한 주제다. ESG의 ‘G’는 기업 내부는 물론 외부까지 총괄하는 거버넌스여야 한다. 지구의 위기를 치유하는 책무 부담은 조세 부담 책무와 같이 응능(應能) 원칙에 따라야 한다. 기후 위기 대응에서 기업은 기본권 주체가 아니라 헌법적 책무의 수범자다. 기업의 기본권 주체성은 국가와 관계에 한정된다. 대기업은 중소기업과 관계에서도 헌법적 책무의 수범자다.
    기업과 자본은 국가 못지않게 중요한 지구 생태주의 헌법의 규율 대상이다. 국가의 임무는 기업의 헌법적 책무를 강력하게 규율하고 촉진하는 것이다. 특히 국가는 중소기업이 기후 위기에 대응하는 헌법적 과제를 수행할 수 있도록 직접적 지원과 함께 중소기업의 자조조직이 기후 위기 거버넌스에 참여할 제도를 구축해야 한다.

    The climate crisis affects every domain on a global scale, demanding a massive paradigm shift for both small and medium-sized enterprises (SMEs) and national SME policies. This is why the issue must be examined from a constitutional perspective.
    The relationship between SMEs and large corporations is not only a traditional task of SME policy but also a crucial theme in responding to the climate crisis. The ‘G’ (Governance) in ESG must encompass both internal and external corporate governance. The obligation to heal the global crisis should follow the principle of “Ability-to-Pay” (capacity), much like the obligation of tax payment.
    In the context of climate crisis response, corporations are not merely subjects of fundamental rights but addressees of constitutional obligations. While corporate personhood regarding fundamental rights is limited to their relationship with the state, large corporations are also addressees of constitutional obligations in their relationship with SMEs.
    Corporations and capital are subjects of regulation under a global ecological constitution, just as significant as the state. The state’s mission is to robustly regulate and facilitate these constitutional obligations of corporations. In particular, the state must provide direct support so that SMEs can fulfill their constitutional tasks in responding to the climate crisis, and establish institutional frameworks that allow SME self-help organizations to participate in climate crisis governance.
