2025년 채권법 중요판례평석 = Analysis of the Supreme Court Cases in 2025 : The Law of Obligations

국문 초록 (Abstract)

2025년 선고된 채권법 분야의 판결들은 양적으로나 질적으로 풍부한 법리적 논점을 제공하였다. 본 평석에서는 그중 7개의 주요 판결을 선별하여 다루었으나, 이 외에도 다수의 판결이 채권법의 법리를 정교화하는 데 기여하였다. 전반적으로 2025년의 판결들에는 기존 대법원의 태도를 유지하면서도 법리를 더욱 정교하게 다듬고, 구체적 타당성을 도모하여 선례와의 조화를 모색하려는 고심을 보여주었다. 물론 개별 사안에 따라서는 법리적 완결성 측면에서 다소 아쉬움이 있거나, 향후의 과제로 남겨진 부분도 존재한다.
구체적으로 각 판결은, 조합원이 이른바 ‘매도인이 선의인 계약명의신탁’을 통해 조합 자산인 부동산의 소유권을 취득한 경우 부동산과 관련하여 지출된 비용의 최종 부담 주체가 누구인지, 보이스피싱 범죄로 명의가 도용되어 체결된 비대면 대출계약의 효력이 명의자에게 미치는지, 전세목적물의 지분 이전이 사해행위가 되는 경우 공동담보가액 산정 시 공제할 전세금의 범위가 전세금 전액인지 채무자의 지분 비율에 한하는지, 임대차보증금 공제 합의의 효력이 제한되는 예외적 사정은 무엇인지, 상계의 소급효를 인정하는 법적 취지는 무엇인지, 무권대리인을 사칭한 제3자의 기망에 속아 본인 계좌에 금원을 송금한 경우 예금주 본인의 부당이득반환 의무가 성립하는지, 이혼에 따른 재산분할 시 불법원인급여 법리가 적용되는지 등의 쟁점들을 다루고 있다.

다국어 초록 (Multilingual Abstract)

The rulings on the Law of Obligations rendered throughout 2025 provided a wealth of legal issues, both in terms of quantity and quality. While this review highlights seven selected major rulings, numerous other decisions have also contributed to expanding the horizons of the Law of Obligations. Overall, the 2025 rulings reflect a concerted effort to maintain the Supreme Court’s existing stance while refining legal principles with greater precision, seeking harmony with precedents to achieve concrete validity. Admittedly, in certain individual cases, there remains some regret regarding legal completeness, or issues left as tasks for future resolution.
Specifically, these rulings address the following key issues: (1) who bears the burden of expenses when a partnership member acquires ownership of real estate—which is the object of the partnership business—through a "contract title trust where the seller is acting in good faith"; (2) whether a victim of voice phishing bears liability for a non-face-to-face loan taken out using their stolen identity; (3) whether the amount to be deducted from the value of the joint security, in cases where the transfer of a share in a Jeonse object constitutes a fraudulent act, is the full Jeonse deposit or an amount proportional to the share; (4) under what circumstances the validity of an agreement to deduct from the security deposit is limited; (5) the legislative intent behind recognizing the retroactive effect of set-off; (6) whether a recipient bears an obligation to return unjust enrichment when a remitter transfers funds to the principal’s account after being deceived by a third party impersonating an unauthorized agent; and (7) whether the doctrine of performance for illegal cause (in pari delicto) applies to property division upon divorce.
