피해자 진술이 양형에 미치는 영향에 대한 메타분석 = A Meta-Analysis on the Effect of Victim Impact Statements on Sentencing Outcomes

국문 초록 (Abstract)

본 연구는 피해자 진술이 형사재판에서의 양형 수준에 미치는 영향을 통합적으로 분석하기 위해 메타분석을 시행하였다. 피해자 진술은 피해자의 절차적 참여권 보장과 응보적 정의 실현 등을 목적으로 도입되었으나, 양형에 미치는 영향에 대해서는 상반된 연구결과가 도출되어 왔다. 이에 본 연구는 선행 실증연구를 수집하여 피해자 진술이 포함된 실험집단과 그렇지 않은 통제집단 간의 양형 차이를 비교할 수 있는 연구자료를 구축하였다. 총 12편의 연구(20개 하위 연구)를 대상으로 승산비에 기반한 메타분석을 시행한 결과, 피해자 진술은 전체적으로 사형 선고 가능성을 1.91배 증가시키는 것을 확인하였다. 또한, 피해자와 진술자의 관계, 진술 방식, 피해자 성별을 기준으로 한 하위집단 분석에서도 유의미하게 증가시키는 효과가 확인되었다. 이러한 결과에 기초하여, 본 연구는 피해자 진술 제도 개선과 공정한 양형 정책 수립에 실증적 근거를 제시하였다.

This study conducted a meta-analysis to examine the effect of Victim Impact Statements (VIS) on sentencing outcomes in criminal trials. While VIS has been introduced to enhance victims' procedural rights and ensure justice, empirical findings on its actual impact on sentencing remain inconsistent. To address this gap, experimental and quasi-experimental studies published between 1989 and 2023 were systematically collected from Google Scholar, ResearchGate, and PubMed. Studies were included if they reported comparative data on sentencing outcomes between cases with VIS and those without, allowing calculation of odds ratios (ORs). A total of 12 studies comprising 20 sub-analyses met the inclusion criteria. The pooled results showed that the presentation of VIS increased the likelihood of receiving a death sentence by 1.91 times. Subgroup analyses further revealed that the magnitude of this effect varied depending on the relationship between the victim and the statement provider, the mode of presentation, and the victim’s gender. These findings provide empirical evidence that VIS meaningfully influences sentencing outcomes and underscore the need for procedural safeguards and policy reforms to ensure fairness and consistency in sentencing practices.
