새 정부의 자치경찰제 설계를 위한 정책적 제언 = Policy Recommendations for Designing a Self-Governing Police System under the New Administration

국문 초록 (Abstract)

이 논문은 문헌연구를 통해 현재 시행 중인 자치경찰제와 그간 논의된 이원적 자치경찰제를 검토하고 이를 토대로 새 정부의 자치경찰제에 대해 정책적 제언을 하는 것을 목적으로 한다.
현재 시행 중인 국가경찰 중심의 일원적 자치경찰제가 가진 태생적 한계는 자치경찰제의 취지를 구현하는데 적잖은 장애물로 작용하고 있다. 1기에 이어 2기 자치경찰위원회가 들어선 현 시점에서도 자치경찰제도의 성공적 운영을 위한 실천적 논의로 온전히 나아가지 못한 채 여전히 규범적･제도적 관점에서 자치경찰제에 대한 논의를 이어가지 않을 수 없는 이유이기도 한다. 그러나 제도적 한계를 극복하고 현행 제도의 틀 내에서 나름 의미있는 성과를 거두고 있음도 부인할 수 없는 사실이다. 자치경찰제를 왜 실시하고, 향후 확대해나가야 할 필요성을 확인하는 지점이다. 또한 제도적 개선을 통해 자치경찰제의 취지를 훼손하는 한계를 걷어내야 하고, 이원화 자치경찰제를 지향해야 하는 이유이다. 다만, 이원화 자치경찰제는 매우 다양한 스펙트럼을 가지고 있다. 현행 자치경찰제 출범 이전 제주자치경찰단의 사례처럼 기존의 국가경찰제를 유지하는 것을 전제로 자치경찰을 신설하는 가장 약한 이원화 모델에서부터 현행 국가경찰의 시도경찰청을 자치경찰화하는 가장 강한 이원화 모델까지 매우 다양하다. 새 정부에서는 이원화 자치경찰제를 국정과제로 제시한 만큼 그간 자치경찰제 운영을 통해 축적한 경험으로 우리 실정에 적합한 한국형 자치경찰제 모델을 찾아나가야 한다.

다국어 초록 (Multilingual Abstract)

This study, based on a literature review, examines the self-governing police system currently in operation as well as the dual self-governing police system that has long been debated, and offers policy recommendations for the newly inaugurated government. The existing unitary self-governing police system, centered on the national police, reveals inherent structural limitations that hinder the realization of the very purpose of self-governing policing. Even after the launch of the second-term self-governing police commissions, discussions have largely remained at normative and institutional levels rather than progressing toward practical measures for successful implementation.
Nonetheless, meaningful achievements have been made within the current framework, demonstrating the continuing necessity of self-governing policing and its future expansion. To ensure the integrity of the system’s objectives, institutional reforms must address and remove structural constraints, while pursuing a dual self-governing police model. The dual model, however, encompasses a wide spectrum, ranging from the weakest version—such as the Jeju Self-Governing Police Corps, which was introduced alongside the national police system—to the strongest version, in which the provincial police agencies of the national police are fully transformed into self-governing police organizations.
Given that the new administration has identified the dual self-governing police system as a national policy agenda, it is imperative to capitalize on accumulated experiences and outcomes of the current system to design a Korean-style model of self-governing policing that is better suited to local realities.
