한국전쟁 전후 민간인학살 분야 진실규명과 3기 진실화해위원회의 과제 = Truth-Finding on Civilian Massacres Before and During the Korean War and Challenges for the Third Truth and Reconciliation Commission, Republic of Korea (TRCK)

국문 초록 (Abstract)

한국전쟁 전후 민간인학살 분야 과거청산을 위해, 진실화해위원회와 같은 국가기구는 법적⋅개별적 차원을 넘어 사건의 구조와 이데올로기적 기제를 드러내는 역사적⋅구조적 진실규명을 해야 한다. 즉, 두 층위의 조사를 함께 수행하는 ‘통합적 진실규명’이 필요하다. 1기 진실화해위원회(2005∼2010)는 개별 희생자 확인에 치중해 역사적⋅구조적 진실규명이 미흡했고, 이후 후속 조치도 한계를 드러냈다. 2기 진실화해위원회(2020∼2025)는 상층부의 이념적 편향성과 비전문성으로 한국 군경⋅미군에 의한 학살 사건의 진실규명 비율이 낮았다. 1⋅2기 위원회를 통틀어 전시⋅전후 국가에 의한 젠더폭력과 여성 피해도 거의 다뤄지지 않았다. 3기 위원회는 법적⋅개별적 진실규명과 역사적⋅구조적 진실규명을 초기 단계부터 통합적으로 수행하는 체계를 구축해, 조사⋅보고서⋅위원회 운영의 전문성과 효율성을 높여 이 분야의 성과를 집대성하고 한국 사회 과거청산을 진일보시켜야 한다.

다국어 초록 (Multilingual Abstract)

This article argues that addressing civilian massacres around the Korean War requires the Truth and Reconciliation Commission, Republic of Korea (TRCK), and similar bodies to move beyond legal and individual case confirmation toward historical and structural truth-finding that exposes organizational dynamics and ideological mechanisms. This demonstrates the need for integrated truth-finding, which combines these layers from the outset. The First TRCK (2005-2010) centered on identifying individual victims, leaving historical and structural inquiries insufficient, and follow-up measures limited. The Second TRCK (2020-2025) showed ideological bias and lack of expertise in its leadership, resulting in low truth-finding rates on massacres committed by Korean security forces and the U.S. military. Across both commissions, gender-based violence by the state-including wartime and postwar harms against women-remained largely unaddressed. A Third TRCK should establish an integrated system early on to strengthen professionalism, improve investigation and reporting, consolidate findings, and advance Korea’s efforts to confront past state violence.
