    대체감미료는 건강한 식생활과 저당 식품에 대한 수요 증가에 부응하며 전 세계적으로 빠르게 보급되고 있다. 그러나 이러한 감미료의 장기적 인체 영향에 대한 과학적 검증은 아직 불완전하며, 특히 누적 섭취에 따른 생리학적 교란 가능성은 명확히 규명되지 않았다. 기존의 유해성 검증은 대부분 설치류를 대상으로 한 단기 독성시험이나 반복투여 실험에 한정되어 있으며, 세대 간 유전독성이나 내분비계·장내 미생물계 교란과 같은 비가시적 생리 변화에 대한 평가는 간접적 수준에 머문다. 본 연구는 대체감미료의 위험성이 환경오염과 유사한 방식으로 장기간 축적되어 추상적이며 예측 불가능한 피해로 이어질 수 있음에 주목한다. 이에 따라 감미료 유해성 검증 체계에 식물연구를 포함한 다층적 실험체계의 법제화 필요성을 제기하며, 이를 사전예방원칙(precautionary principle) 및 헌법상 국가의 보호의무라는 법리적 기반에 따라 논증하고자 한다. 식물은 수질·토양 오염물질에 대한 생태 지표 생물로 널리 활용되어 왔으며, 최근 연구들은 감미료가 식물의 성장, 발아, 생리 대사에 영향을 미칠 수 있음을 실증적으로 보여주고 있다. 따라서 식물기반 독성평가를 감미료 허가 절차에 법적으로 포함시키는 것은 과학적 정당성과 헌법적 당위성을 동시에 확보하는 예방적 규범 실현 방식이 될 수 있다.

    Alternative sweeteners have rapidly spread worldwide in response to increasing demand for healthy diets and low-sugar food options. However, scientific evaluation of their long-term effects on the human body remains incomplete. In particular, the potential for physiological disruptions caused by accumulated intake has not been clearly established. Existing toxicity assessments primarily rely on short-term studies involving rodents or limited human data, failing to capture generational genotoxicity or disturbances in the endocrine and gut microbiome systems. This study highlights the similarity between the latent dangers of alternative sweeteners and those of environmental pollution—both being accumulative, abstract, and unpredictable in nature. Therefore, it advocates for the legal inclusion of plant-based, multi-layered experimental systems in the toxicological evaluation process. The theoretical foundation of this proposition rests on the precautionary principle and the constitutional duty of the state to protect public health and the environment. As plant organisms have long served as ecological indicators for pollutants in water and soil, recent research demonstrates that sweeteners may also affect plant growth, germination, and metabolism. Thus, incorporating plant-based toxicity testing into the legal approval process for sweeteners can fulfill both scientific rigor and constitutional legitimacy as a preemptive normative safeguard.
