    멕시코 노동법은 라틴 아메리카 지역에서 가장 독특한 헌법적・사상적 기초를 가진 법체계 중 하나로 평가받는다. 특히 1917년 제정된 멕시코 헌법 제123조는 세계 최초로 사회권(노동권 및 사회보장권)을 헌법에 명시한 규정으로, 노동시간의 제한, 최저임금 보장, 부당해고의 제한, 의제해고, 근로자의 이익균점권, 단결권 및 파업권의 보장, 노사정 3자 기구에 의한 분쟁해결, 산업안전, 재해보상 등 핵심 권리들을 제도화하였다. 본 논문은 이러한 노동법의 연원이 어떠한 역사적・정치사회적 맥락 속에서 형성되었는지를 검토하고, 그에 담긴 ‘정신’을 분석하고자 한다.
    본 연구는 멕시코 혁명이라는 대규모 민중운동, 노동관계에서의 사법(私法)으로부터의 탈출, 그로부터 형성된 ‘사회정의’(justicia social)라는 정치이념이 노동법의 규범적 기초로 자리잡았다는 점을 밝힌다. 특히 멕시코의 대표적인 노동법학자이자 라틴 아메리카 노동법에 지대한 영향을 주었던 마리오 데 라 쿠에바(Mario de la Cueva)의 이론은 이러한 정신을 법체계 내에 정착시키는 데 결정적인 역할을 하였다. 그의 입장은 노동법이 단순히 계약법의 수정이 아니라 경제적 약자의 지위를 보호하는 ‘사회법’으로서의 정체성을 갖는다고 본다. 멕시코의 노동법전(Ley Federal del Trabajo)과 제도적 장치는 이러한 정신을 바탕으로 형성되었으며, 국가가 노동문제에 적극 개입하는 방식을 보여준다. 멕시코 노동법은 그 스스로 ‘사회정의’의 달성이 노동법의 목적이라고 밝히고 있는 만큼 멕시코 노동법은 ‘사회정의’라는 가치에 기반한 법체계로 이해되어야 한다. 이는 향후 비교법 연구 측면에서 노동법은 무엇을 보고 어디로 가야 하는가라는 관점에서 중요한 참고 자료로 생각할 수 있다.

    Mexican labor law is recognized as one of the most ideologically and constitutionally grounded legal systems in Latin America. The Mexican Constitution of 1917, particularly Article 123, became the first in the world to constitutionally enshrine fundamental labor rights, including limited working hours, minimum wage guarantees, protection from wrongful dismissal, right to organize and right to strike.
    This study investigates the historical and political origins of Mexican labor law and explores the philosophical foundations embedded in its legal structure. It argues that the Mexican Revolution and the ideological drive toward “social justice” significantly shaped the formation of labor law. In particular, the theoretical work of Mario de la Cueva established the identity of labor law as a form of social law aimed at protecting the economically weaker classes, rather than as an extension of private contract law. Institutional mechanisms such as the Federal Labor Law (Ley Federal del Trabajo) reflects a model where the state plays a mediating and regulatory role in labor relations. This paper contends that the spirit of social justice remains a crucial interpretive key for understanding the evolution and future direction of Mexican labor law.
