This study examines the Legislative Bill on the National Investigation Commission to suggest legislative improvements. The establishment of the National Investigation Commission aims to enhance democratic control over investigations and serve as a mediator between investigative agencies. However, several issues raise concerns about its practical effectiveness. The nomination and appointment process for commissioners is susceptible to political influence, potentially compromising the Commission’s neutrality. Moreover, the qualifications for commissioners are vague, which cannot guarantee the Commission’s capacity for professional deliberation. The broad scope of the Commission’s authority also poses risks to the autonomy of current investigative agencies. Without clear procedural rules regarding appeals and review processes for non-prosecution decisions, the Commission may face administrative inefficiencies and procedural confusion. The National Investigation Commission requires a legislative framework that ensures its independence, expertise, structural coherence, and procedural efficiency.
