위헌법률심판에서 재판의 전제성과 예외로서 심판의 필요성 = Determining Prerequisite for Constitutional Adjudication

국문 초록 (Abstract)

재판의 전제성은 위헌법률심판의 적법요건 중에서도 가장 중요한 요소로 헌법재판소가 구체적 사건에서 위헌 여부를 판단할 수 있도록 구체성을 보장하는 기준으로 작용한다. 그러나 헌법재판소가 채택하고 있는 예외로서 심판의 필요성 기준에는 객관성 결여와 자의적 운용이라는 문제가 발생하고 있다. 이는 위헌법률심판 제도의 실효성을 약화시키고 헌법재판소와 법원 간 협력적 관계를 저해하며 국민적 신뢰를 저하시키는 결과를 초래한다.
본 연구에서는 먼저 현행헌법상 위헌법률심판을 개관한 뒤 헌법재판소의 재판의 전제성 판단 현황을 분석하고 관련 사안를 검토하였다. 예외로서 심판의 필요성을 인정하여 본안판단으로 나아간 사안과 각하결정을 선고한 사안을 비교하여 헌법재판소 기준의 문제점을 지적하였다. 그리고 적법요건 판단에 있어 헌법재판소법 제28조에 규정된 보정 절차를 적극적으로 활용함으로써 헌법재판소가 제청법원과의 협력적 관계를 강화하고 사건 심리 과정에서 발생할 수 있는 갈등과 혼란을 완화할 필요성을 제안하였다. 또한, 위헌법률심판에 내포된 각하결정의 특수성을 논의하며 헌법재판소가 각하결정을 내릴 때 제청법원의 판단을 존중함과 동시에 헌법적 가치 실현을 위한 객관적 기준을 재정립할 필요성도 강조하였다.
위헌법률심판은 단순히 특정 사건의 해결을 넘어 헌법적 질서를 수호하고 기본권 보호를 강화하는데 목적이 있다. 이에 따라 헌법재판소는 재판의 전제성 판단 기준을 객관적이고 일관되게 설정하여 사법부에 대한 국민적 신뢰를 강화하고 관련 헌법적 논란을 해소해야 할 것이다.

This study critically examines "trial relevance," a key prerequisite for constitutional adjudication by the Constitutional Court of Korea. As the most essential procedural requirement, trial relevance serves as a standard to ensure case specificity, allowing the Court to carefully and thoroughly assess the constitutionality of statutes. Despite its importance, issues such as lack of objectivity and arbitrary application in the Court's decision-making process have emerged, undermining the effectiveness of constitutional adjudication. These issues further disrupt cooperative relations between the Constitutional Court and referring courts, while also contributing to the erosion of public trust in the judiciary.
The study provides a detailed review of the normative basis and institutional significance of constitutional adjudication, analyzes the application of trial relevance in practice, and identifies critical flaws in the Court’s criteria by comparing cases where trial relevance was upheld and substantive rulings issued with cases dismissed for its absence. Based on this analysis, the study proposes active utilization of remedial measures under Article 28 of the Constitutional Court Act to strengthen cooperation between the Constitutional Court and referring courts, reducing conflicts and confusion in the adjudication process. Furthermore, it emphasizes the necessity for objective and consistent standards in dismissal decisions to better align judicial practices with constitutional values. Ultimately, the study underscores the importance of refining the criteria for trial relevance, not only to restore public trust in the judiciary but also to uphold the integrity and effectiveness of the constitutional adjudication system.
