통합적 화학물질 관리체계 구축을 위한 입법론 = Legislative Study on the Integrated Chemical Risk Control System

In response to the Gumi hydrofluoric acid leakage accident and the humidifier disinfectant incident, Korea has established three major laws against chemical risks. These are the Act on Registration and Evaluation of Chemical Substances, the Chemical Substances Control Act, and the Consumer Chemical Products and Biocides Safety Control Act. However, laws and regulations on chemical substances or products are implemented by several ministries and administrations that are not operating organically linked to each other. This seems to be the main reason why our society has yet to shake off chemical anxiety.
This article presents legislative solutions to introduce an integrated chemical risks control system. To achieve this, this article examined the problems and limitations under the current legal system to assess and manage chemical risks. It also looked at some laws on the integrated chemical substances control systems in the United States, the European Union and Japan, aiming to obtain some lessons from them.
Based on these analyses, this article suggests the enactment of the “Framework Act on Chemical Safety” and the revision of related laws as the Act on Registration and Evaluation of Chemical Substances. The Framework Act is necessary to establish basic principles appropriate for chemical risk control, allow provisions to develop department-integrated administrative plans on chemical risks, and ensure inter-departmental cooperation.
All problems and limitations cannot be solved only by the enactment of the Framework Act. The scope of the Act on Registration and Evaluation of Chemical Substances should be expanded, and the chemical risk information under the Act should be communicated to laws on controlling risk from various types of chemical products. In other words, it is also necessary to revise individual laws related to chemical risks.

국문 초록 (Abstract)

리나라는 구미 불산누출 사고와 가습기 살균제 사건 이후 화학 3법 체계를 갖추었으나, 여전히 화학물질 및 화학제품 관련 법령이 부처별로 분산된 채로 서로 유기적으로 연계되어 운영되고 있지 못하고 있으며, 이는 우리 사회가 아직까지도 화학물질로 인한 불안을 떨쳐버리지 못하고 있는 주요 원인이 되고 있다.
이 글에서는 현행 화학물질 관리체계의 문제점을 재점검하고, 미국이나 EU 등의 화학물질 통합관리체계가 주는 교훈을 보태어 그 문제점을 극복하기 위한 기본적인 구상을 제시하는 한편, 이를 제도화하기 위한 입법론을 펼치고 있다.
그 입법대안으로 가칭 ‘화학안전기본법’의 제정, 그리고 화평법 등 관련 법령의 개정을 제안하고 있다. 먼저, 통합적인 화학물질 관리체계 구축을 위한 법제 개선을 이루어내기 위해서는 (i) 여러 관계부처가 얽혀 있는 화학물질 관리의 특성상 기본이념이나 기본원칙을 정립할 필요가 있다는 점, (ii) 부처 통합적인 행정계획이나 시책 수립 등과 같은 규정을 두고 그에 기반하여 각각의 개별법령으로 환류되도록 할 필요가 있다는 점, (iii) 화학안전이라는 과제는 국가적 과제로서 범부처적으로 협력하여 추진할 것이 요구되고, 이를 위하여 부처횡단적 추진기구를 둘 필요가 적지 않다는 점 등을 고려할 때, 기본법 제정의 필요성이 인정된다.
또한, 기본법의 제정만으로 모든 문제가 해결될 수 있는 것은 아니며, 화평법이 그야말로 물질 관리라는 목적을 제대로 달성하기 위해서는 화평법 그 자체를 개정하여 적용제외대상을 정비하는 등의 입법조치가 필요할 것이며, 그 밖의 노출 관리를 규율하는 법령이 화평법에 따라 생산･관리되는 화학물질의 유해성･위해성 등의 정보를 그에 따른 안전기준 설정이나 개별적인 노출 평가 단계 등에 있어서 적절하게 활용할 수 있도록 하기 위해서는 개별 법령의 개정도 함께 이루어져야 할 것이다.
