    South Korea introduced, in 2013, a new adult guardianship system and replaced with it the former incompetency system. The article 18(1)1 of the Public Election Act which put persons declared incompetent among those deprived of the right to vote, however, remained unchanged. An Attempt to abolish this deprivation was unsuccessful. Attempts to explicitly deprive persons under guardianship of their right to vote also have failed, due in part to the National Election Commission that expressed its opinion that adults under guardianship should also enjoy their rights to vote on an equal basis with others. Meanwhile, many countries, including Germany, France, and Japan, that have previously restricted the voting rights of persons with mental disabilities have abolished the restriction and are now working to ensure that they can effectively and fully exercise their rights to vote. Such legislative reforms were influenced by the UN Convention on the Rights of Persons with Disabilities, which South Korea is one of the State Parties.
    The latest revision of the French Electoral Code, which abolished all limitations on the right to vote for persons with mental disabilities, has implications in two respects. The first is the extent to which persons with mental disabilities are guaranteed suffrage. Under the old system, the French courts judged whether or not a person under guardianship is to keep his/her right to vote. The system met with various criticism at home and abroad, which led to a 2019 reform of the French Code of Election. Most of the criticism of the old french system is also valid in the discussions on revising Korea’s Public Election Act. They can support the argument that persons with mental disabilities should also be allowed to exercise fully their rights to vote and any limitation on these rights is discrimination against persons with disabilities. The second is the extent of support to ensure the effective exercise of these rights. Institutional supports from leading countries to guarantee the universal suffrage of persons with mental disabilities are similar in a nutshell, but the details vary from country to country. As one of the efforts to secure the sincerity of voting, France prohibits a certain type of people, such as public guardians, managers, and employees of care facilities, from exercising the right to vote on behalf of persons with mental disabilities. It is also worth noting the collaboration between the French government and various associations of persons with disabilities. Although candidates are not yet legally bound to provide easy-to-read campaign materials, associations themselves provide, with government funding, materials explaining the voting system in easy-to-read documents and videos.
    A new bill to revise the Public Election Act has been submitted to the 21st National Assembly. This bill is a step forward compared to the previous bills in that it puts at the forefront the restoration of the right to vote for persons with mental disabilities, but it still has its limitations in that it provides no active measures to guarantee the effective exercise of their rights to vote. This article may present grounds for future legislative debates to amend the present bill and provide measures to ensure that persons with disabilities can effectively and fully participate in public elections.

    성년후견 제도 시행 이후 금치산자의 선거권을 박탈하는 공직선거법 제18조 제1항 제1호의 개정 시도가 계속되었다. 중앙선거관리위원회는 이미 2014년에 피성년후견인의 선거권을 전면인정하는 것을 내용으로 하는 정치관계법 개정의견을 국회에 제출하기도 하였다. 그러나 피성년후견인의 선거권 인정 여부에 대한 의견 대립으로 법 개정에 성공하지 못한 채 오늘에 이르렀다. 그동안 기존에 피성년후견인의 선거권을 전면적 또는 부분적으로 제한하였던 나라 중 독일, 프랑스, 일본 등 여러 나라가 정신적 장애인에 대한 선거권 제한 규정을 전면 철폐하고 이들이 선거권을 실질적으로 행사할 수 있도록 편의를 제공하는 내용으로 선거법제를 개정하였다. 이는 우리나라도 비준한 UN 장애인권리협약의 영향을 받은 것이다.
    UN 장애인권리협약 비준국인 프랑스가 최근에 행한 선거법제 개정 내용은 두 가지 측면에서 시사점이 있다. 첫 번째는 정신적 장애인에 대한 선거권 보장의 범위라는 측면이다. 프랑스는 법원이 피성년후견인의 의사결정능력 정도를 고려하여 선거권 박탈 여부를 결정하도록 한 대표적인 국가였으나, 국내외적으로 여러 비판에 직면한 끝에 의사결정능력 장애를 이유로 한 선거권 제한 규정을 폐지하였다. 구법 제도에 대한 비판의 대부분은 우리나라의 공직선거법 개정 논의에서도 그대로 타당한 것들이며, 우리 공직선거법 개정도 피성년후견인의 선거능력을 개별적으로 평가하는 것이 아니라 선거권 제한을 전면 폐지하는 방향으로 가야 한다는 주장을 뒷받침할 주요 논거가 된다. 두 번째는 정신적 장애인의 선거권 행사를 실효성 있게 보장하기 위한 지원 제도의 측면이다. 정신적 장애인의 선거권 보장을 위한 주요국들의 제도적 지원은 큰 틀에서 유사하지만, 그 구체적 내용은 나라별로 차이가 있다. 장애인 거주시설 운영자 등 정신적 장애인에게 부당한 영향력을 미칠 우려가 있는 자에게는 정신적 장애인의 선거권을 대리행사하거나 투표행위를 보조할 수 없도록 한 프랑스의 제도는 투표의 진정성을 확보하기 위한 프랑스의 노력을 보여준다. 법률상 강제되지는 않으나 읽고 이해하기 쉬운 방식의 문서와 동영상을 이용하여 선거제도와 투표방법을 교육하려는 프랑스 정부와 장애인단체들의 협업에도 주목할 필요가 있다.
    제21대 국회에서도 공직선거법 개정법률안이 제안되었다. 위 개정법률안은 정신적 장애인의 참정권 회복을 전면에 내세우고 있다는 점에서 이전의 개정안들에 비하여 진일보한 측면이 있으나, 정신적 장애인의 특수성을 고려하여 이들의 선거권 행사를 실질적으로 보장하기 위한 적극적인 조치가 전혀 고려되지 않았다는 점에서 한계가 있다. 공직선거법 개정 논의에서 정신적 장애인에 대한 실효성 있는 투표편의를 제공할 수 있도록 제도보완이 함께 이루어질 수 있기를 기대한다.
