중증장애인의 선거권 배제에 대한 헌법적 고찰 = Constitutional Consideration on Exclusion of Voting Rights for Severely Handicapped Person

In South Korea, the civil law was revised to eliminate the Sentence of Quasi-incompetence and Incompetency and changed to a Guardianship System. The Public Official Election Act stipulates that those who do not have the right to vote and still have a sentence of Incompetency make it unclear whether an adult guardian has the right to vote. Under the Public Official Election Act, if a person who is pronounced Incompetency in court is uniformly amended as an adult guardian, he/she will be deprived of the right to vote of the adult guardian who can make political judgment and vote in public official election. This is likely to violate the right to vote of the adult guardian. Article 13 (2) of the German Federal Election Act stipulates that a severely handicapped person whose adult guardianship has been initiated by a court shall be excluded from the German Parliamentary and European Parliamentary election. A petition was challenged with the Federal Constitutional Court of Germany whether Article 13 (2) of the German Federal Election Act is consistent with the German Constitutional Law. Article 13 (2) of the German Federal Election Act, which does not grant the right to vote to adult guardian, violates the universal ballot principle of “Every citizen has the right to vote and to be elected in principle” in article 38 (1) p.1 of the German Constitutional Law. Article 13 (3) of the German Federal Election Act, which excludes the right of incapacitated prisoner in incompetent mental hospital, is an imposition of penalties for the ‘disability’ of article 3 (3) p.2 of the German Constitutional Law. Thus, Article 13 (3) of the German Federal Election Act, which excludes the right to vote in person who is held in mental hospitals, is in violation of the ‘no penalties’ on the grounds of ‘disability’ in article 3 (3) p.2 of the German Constitutional Law.

국문 초록 (Abstract)

독일 연방선거법 제13조 제2호에서 성년후견심판을 받아 성년후견이 개시된 중증장애인에게 독일 연방의회선거 및 유럽의회선거에서 선거권을 배제하도록 한 규정과 독일 연방선거법 제13조 제3호에서 정신병원에 수용되어 있는 사람의 선거권을 배제하도록 한 규정이 있었다. 이러한 독일 연방선거법 제13조 제2호, 제3호가 독일 기본법에 합치되는지 여부를 독일 연방헌법재판소에 선거소원심판이 청구되었다. 독일 연방헌법재판소는 피성년후견인과 정신병원 수용자에게 선거권을 부여하지 않고 있는 독일 연방선거법 제13조 제2호, 제3호가 독일 기본법 제38조 제1항 1문의 ‘국민은 누구나 원칙적으로 선거권과 피선거권을 가진다’는 보통선거원칙에 위반된다고 판시하였다. 정신병원에 수용된 책임무능력자의 선거권을 배제하는 독일 연방선거법 제13조 제3호는 독일 기본법 제3조 제3항 2문의 ‘장애’로 인한 불이익 부과에 해당한다. 독일 연방헌법재판소는 정신병원에 수용되어 있는 자에게 선거권을 배제하는 독일 연방선거법 제13조 제3호는 독일 기본법 제3조 제3항 2문의 ‘장애’를 이유로 한 ‘불이익 금지’에 위반된다고 판시하였다. 우리나라는 「민법」 개정을 통해 금치산선고․한정치산선고 제도를 폐지하고 성년후견 제도로 변경하였지만, 「공직선거법」에는 선거권이 없는 자 중의 하나로 여전히 ‘금치산선고를 받은 자’를 규정함으로써, 피성년후견인이 선거권을 가지는지 여부가 불분명하다. 「공직선거법」상 ‘금치산선고를 받은 자’를 ‘피성년후견인’으로 일률적으로 개정하게 되면, 공직선거에 있어서 정치적 판단을 할 수 있고 투표에 참여할 수 있는 피성년후견인의 선거권까지 일률적으로 박탈하는 결과를 초래하므로, 이는 피성년후견인의 선거권을 침해할 가능성이 높다.
