한문소설 속 성의 윤리와 정의 개념의 모순 = The Ethics of Sexuality in Korean Novels in Chinese Letters & the Contradiction of the Conception "Justice"

다국어 초록 (Multilingual Abstract)

This essay tries to analyse two Korean classic novels in the premise that there is ethical contradiction in the origin of the discourses about justice. The coincidence between the judical justice made from society and the ethical judgement originated from subject, of course, would be one of the ultimate goals of humankind. But it is not possible yet, and because of the impossibility various ethical, literal discourses on the topic could have been produced till now. The representative literal appearance generated from this gap of the contradiction is the narrative of love & desire.
The narrative of love & desire had begun from the attempt to humanized the savage desire attributed to nature and to establish it as new ethics. Kimhyunkamho(｢金現感虎｣) was the representative work of that humanizing process. This ethical process was designed to violate the principle of justice symbolized as 'effort for another's benefit(‘利物’) and 'tiger girl's sacrifice' is the symbolic accident in the Korean traditional narratives. This sacrifice narrative formed from the viewpoint that regarded women as the residue of savageness in later days, at the stage of Pouikyojip(｢布衣交集｣), could develop into the love narrative contains the issue of female identity.
If the love could symbolize the beginning of human ethics, trying to modify it in the view of justice means the reconstructing the concept of humanity. Therefore the legislation of justice as the realization of humanity is not the case could be performed at the angle of judical modification on 'the effort for another's benefit(‘利物’). It have to be rejustified through the fundamental retrospection of our ethical attitude toward sexuality and love.

국문 초록 (Abstract)

이글은 정의 담론의 기원에 윤리적 모순이 있다는 전제하에 한문소설을 분석하고자 하였다. 사회가 만든 사법적 정의와 주체의 윤리적 선택이 일치하는 것은 인류문명의 궁극적 목표지만 아직 불가능하며, 그것이 불가능하기에 다양한 윤리적, 문학적 담론들이 여전히 생성되고 있다 할 것이다. 이 모순의 빈틈에서 산출된 대표적인 문학 현상이 사랑과 욕망의 서사다. 사랑과 욕망의 서사는 자연에 속한 야생의 욕망을 인간화시켜 윤리로 정립하려는 노력에서 출발하는데 이를 대표하는 작품이 ｢金現感虎｣다. 그런데 이 윤리화 과정은 ‘利物’로 상징될 정의의 원리를 위반하도록 설계되어 있는 바, 그것을 상징하는 사건이 ‘호녀의 희생’이다. 여성을 야만의 잔여로 간주하려는 태도로부터 유래한 이 희생의 서사는 훗날 ｢布衣交集｣ 단계에 이르러서는 여성의 정체성 주장을 담은 사랑의 서사로 발전하게 된다. 사랑이 인륜의 시발점을 상징한다고 할 때, 이를 정의의 관점에서 재조정한다는 것은 결국 인간에 대한 재구성을 의미한다 할 것이다. 따라서 인륜의 구현으로서 정의를 다시 입법화하는 것은 단지 ‘利物’에 대한 사법적 조정의 수준에서 이뤄질 사안이 아니다. 그것은 성과 사랑에 대한 인류의 윤리적 태도를 근본적으로 반성하는 차원에서 재정립되어야 한다.
