인권으로서의 건강권에 대한 탐색과 전망 = Right to Health as Human Right in post -Industrial society

국문 초록 (Abstract)

인권은 최소한의 권리를 규정하고 보호하기 위한 보호막의 역할과 동시에 인간이 누릴 수 있는 높은 수준의 삶의 권리를 포함하는 개념이다. 인권으로서의 건강권은 기초적인 음식, 물, 의료, 기타 건강 환경의 확보라고 하는 최소주의적 관점으로부터 보다 높은 수준의 삶의 질과 관련된 건강권 확보라고 하는 최대주의적 접근으로 이동하고 있다. 최대주의 접근은 또한 후기산업사회의 사회변동에 따른 여러 문제들을 건강권 논의로 포섭하고자 한다. 이 글은 건강권 영역의 확대에 따른 기존 논의들,특히 알마아타(Alma Ata) 선언 이후 제기된 건강권의 여러 논점들을 소개하고, 현재 후기 산업사회에서 건강권과 관련되어 쟁점이 될 만한 사안들을 조명해 보고 있다. 즉, 건강, 의료 시스템, 삶의 질,글로벌차원이 국가개입과 협조, 의사결정과정에서의 참여과정 등 건강권이 확대되는 과정과 유연화와 같은 작업방식의 변화, 지구온난화로 인한 생태계의 변화, 의료 시장의 확대, 과학기술실험 등 건강권과 연관된 새로운 논제들을 간단히 정리해 보기로 할 것이다.

다국어 초록 (Multilingual Abstract)

The Concept of Human right has been transforming from the Minimum principle to Maximum principle directing the high level of the right as much as they can. This paper has attempted to discuss the right of health in order to examine the possibility of Maximum principle of the health, taking the case of shift workers. The Minimum principle base on the disease, access to health care system, environment of health such as water, food etc. has been enlarged to be a Maximum principle requiring the right of health related to development of science and technology, the change of ecological environment, maketization of health especially flexibility of labor market etc. in post industrial society. The Maximum principle of human right is of significance in making these new agenda in the field of human right in postindustrial society.
