‘안아키’ 논란에 대한 사회 윤리적 고찰 : 아동의 건강권과 간섭주의를 중심으로 = A Socioethical Study on AhnAki Disputation: Focusing on Children’s Right to Health and Paternalism

국문 초록 (Abstract)

이 논문은 소위 ‘안아키’ 논란을 사회 윤리적 관점에서 접근해보고자 하는 시도이다. ‘안아키’ 논란에서 핵심적인 문제는 아동의 건강권이다. 이 문제와 얽혀있는 상징적인 것은 백신 접종 논쟁이다. 이 논쟁에서 고려되어야 할 문제는 ‘안아키’ 부모가 아이들을 대리하여 치료를 결정할 때의 정당성 문제이다. 이와 관련된 또 다른 문제는 개인의 자유의 한계와 국가 간섭의 정당성 문제이다. 이 논문에서 필자는 ‘안아키’ 부모의 온정적 간섭주의가 유일하게 기댈 수 있는 사후동의가 가진 한계를 하버마스와 칸트에 기대어 지적하였다. 또한 필자는 ‘안아키’의 자연치유법과 그에 대한 국가 간섭의 문제를 밀의 자유 우선적 관점과 해악의 원리에 따라 살펴보았다. 자유 우선적 관점은 국가의 간섭을 상호 상충되는 것처럼 보일 수 있다. 여기서 필자는 국가의 간섭이 해악 금지의 원리에 의해 자유 우선적 관점과 조화될 수 있다고 지적한다. 따라서 ‘안아키’의 자연치유법과 백신 접종 거부에 대한 국가의 개입은 정당하다고 논증할 수 있다.

다국어 초록 (Multilingual Abstract)

This paper aims to approach the so-called AhnAki dispute from a socioethical point of view. A key issue in this dispute is children’s right to health, which was brought out by a dispute over vaccinations. A question to be considered in this controversy is the legitimacy of the AhnAki parents in making decisions on behalf of their children concerning treatment. Other related questions include the limitation of individual freedom and the legitimacy of state intervention. In this paper, I suggest that following Jürgen Habermas and Immanuel Kant, ex post facto approval as the only basis of paternalism also has limits. In addition, I have examined the problems of so-called ‘natural therapy’ and the intervention of the state in the AhnAki case according to Mill’s view on the priority of liberty and harm principle. The view on the priority of liberty may seem to be at odds with the harm principle. Here, I state that the intervention of the state can be in accordance with the view on the priority of liberty based on the harm principle. Therefore it is reasoned that the intervention of the state in the matter of AhnAki’s choice between vaccinations or ‘natural therapy’ can be justified.
