유엔 북한인권조사위원회 최종보고서의 성취와 문제점 = The UN Commission of Inquiry on Human Rights in North Korea: Achievements and Some Issues

In 2014, the U.N. Commission of Inquiry on Human Rights in the Democratic People’s Republic of Korea, under the U.N. Human Rights Council, released its 372 page final report after an investigation of about one year. In December, the U.N. Security Council had the first official briefing, which surprisingly marked the very first incidence of the Security Council involvement with North Korean human rights issues. It was an outcome of a landmark report by a U.N. Commission of Inquiry. However, so far, there has not yet been any thorough assessment of the commission and its final report, albeit the significant and wide spread referral to the findings and recommendations. This essay evaluates the report based on its approach, methods and evidence by situating its report within existing governmental and nongovernmental human rights reporting practices on North Korean human rights. I discuss three achievements of the commission’s report and explore what these strengths mean for the future implementation of the commission’s recommendations. In addition, I critically review the content of the report and identify three problems and issues with the current report, which, if possible, should be considered and overcome in similar inquiries in the future.

국문 초록 (Abstract)

2014년 2월 유엔인권이사회 산하의 유엔 북한인 권조사위원회는 약 1년의 조사결과를 바탕으로 372 쪽 분량의 최종 보고서를 발간했다. 같은 해 12월, 유엔 안전보장이사회는 처음으로 북한 미사일이나 핵문제가 아닌 인권문제를 의제로 채택하였고, 북한 인권에 관한 의미 있는 첫 공식 브리핑을 가졌다.
이 모든 결과는 유엔 북한인권조사위원회의 기념비 적인 최종보고서로부터 시작된 일이며, 현재까지도이 보고서는 북한 인권문제에 관한 다양한 논란의 중심에 위치해있다. 하지만, 이 보고서에 대한 면밀한 분석과 평가는 이루어지고 있지 않은 형편이다.
그래서 본 논문은 이 보고서가 채택한 접근법과 방 법, 다양한 주장의 근거를 기존 정부 및 비정부기구의 북한 인권문제 보고 경향과 비교하여 평가한다.
우선 북한인권조사위원회 최종보고서의 세 가지 성취점을 설명한 후 이것이 국제사회가 향후 위원회의 권고사항을 이행하는 데 있어 주는 함의를 분석한 다. 다음으로 보고서가 갖고 있는 한계와 문제점을 살펴보고 이러한 약점들이 향후 국제사회의 활동에서 어떻게 보완되고 수정될 수 있는가 고찰한다.
