관타나모 테러용의자 수용소의 현황과 폐지에 따른 법적, 교정 정책적 함의

국문 초록 (Abstract)

지난 2월 23일 오바마 미국 대통령은 관타나모 베이에 있는 테러용의자 수용시설을 폐쇄하겠다는 계획을 미 의회에 제출했다. 그 계획은 현재 남아있는 91명의 수용대상자 가운데 석방적격자인 35명을 해외로 이송하고 나머지 56명을 미국본토로 이송하는 내용을 담고 있다. 그 간 이른바 관타나모 수용소로 불린 이 수용시설은 여러 인권침해시비 논란의 중심에 있어왔다. 관타나모 수용소를 둘러싼 인권침해여부에 대한 뜨거운 논쟁에도 불구하고, 이 문제에 대해 체계적이고 본격적인 관심을 갖는 이는 많지 않다. 특히 우리사회에서 이 관타나모 수용소와 관련된 실체적 진실과 현황, 그리고 법적 쟁점과 정책적 함의 등에 대해서는 자세히 알려진 바는 없다. 하지만 관타나모 수용소의 현황과 사실 등, 그리고 이를 둘러싼 법적 쟁점과 정책적 함의 등은 대테러 정책을 수행함에 있어 매우 중요한 사실들을 포함하고 있다. 특히, 이번 테러방지법의 통과로 시행령을 포함하여 구체적인 정책들을 마련하고 추진해 나가야 하는 우리 상황은 대테러 활동과 관련된 법제적, 정책적 사안들에 대한 지식과 역량 등을 축적해 나가야 할 필요성을 제기한다. 이 연구는 그러한 취지에서 관타나모 수용소를 둘러싼 미국의 경험에 대해 살펴보고 우리에게 참조될 만한 시사점등을 파악해 볼 것이다. 이를 위해 관타나모 수용소의 현황과 법적 쟁점들을 살펴보고 예상되는 관타나모 시설의 폐지와 미국 내로의 수용자 이송에 따른 관련 법적, 정책적 쟁점사안들을 짚어 볼 것이다. 이 연구를 통해 앞으로 우리국가가 대테러 활동을 수행함에 있어 테러리스트 및 테러 용의자 구금시설과 관련된 여러 문제들과 쟁점사안들을 미리 준비하는데 기여할 수 있기를 기대한다.

다국어 초록 (Multilingual Abstract)

Recently, the U.S. President Obama proposed the plan of terrorist detention camp in Guantanamo Bay. According to the proposal, the 56 prisoners among the total 91 currently remaining prisoners will be transferred into the U.S. mainland, except the 35 who are qualified for the release and thus scheduled to be transferred into the foreign countries. For long after its establishment, the so-called Guantanamo Detention Camp has been the center of the heated arguments on human rights’ violations. However, despite such debates, little systematic and substantial attention was paid. Particularly, little has been known to the Korean society regarding facts, prevalence, legal issues, and policy implications of the Camp. Indeed, the Guantanamo issues includes grave importance for our counterterrorism steps in the future in that the Korean society now faces the necessity of the build-up for the knowledge, know-how, and capability of the counterterrorism legal tools and policy implications with the recent passage of the Anti-terrorism Bill. This study examines the U.S. experience on the Guantanamo Detention Camp and its surrounding issues and proposes some recommendations in the Korean context. For doing so, it discusses the prevalence and legal issues of the Guantanamo Detention Camp and predicts the legal and policy issues with the respect of the shutdown of the Camp and the transfer of the prisoners into the U.S. mainland. Hopefully, this study could contribute to our future counterterrorism preparations in association with the terrorist detention facilities and various related problems and issues.
