한국문제를 통한 UN법의 발전 = Development of the United Nations Law through Korean Questions

국문 초록 (Abstract)

대한민국과 UN은 오랜 세월동안 수많은 관계를 형성해 오는 가운데, 한국문제를 통한 UN법의 발전도 적지 않았다. UN은 특히 창설 초반 한국문제를 다루는 가운데 불분명하던 헌장의 의미를 명확히 하거나, 헌장의 허점을 보완하는 계기를 삼았다. 그러한 예로 UN의 신규 회원국 가입 절차의 명확화, 상임이사국 결석의 의미 확인, 비상특별총회 제도의 도입, 국제평화와 안전의 유지에 관한 총회의 역할 확인, 헌장이 예정하지 않았던 UN군의 창설 등을 들 수 있다.

다국어 초록 (Multilingual Abstract)

The Republic of Korea has maintained politically close relationship with the United Nations(UN) since her establishment, even though Korea became a member of the UN in 1991. The UN was deeply involved in Korean questions as a sponsor for founding independent Government of the Republic of Korea in 1948. Since then Korean questions had been hot topic at the many stages of the UN diplomacy. Through Korean questions some issues of the UN law got clear meaning or new interpretation. In this Article following points are analysed from such a point of view: ① Procedure of the admission of new members, especially concerning each role of the General Assembly and the Security Council, ② Meaning of the absence of permanent member at the Security Council, ③ Introduction of the emergency session of the General Assembly through the “Uniting for Peace” resolution, ④ Confirmation of the second role of the General Assembly for maintaining the international peace and security, ⑤ Introduction of the franchised style of the UN forces.
