      The Republic of Korea has grown into the world``s top ten trading nations after the establishment of government. But it is also true that the government transparency index of Korea has not deviated from the humble level. Many of legislations for the purpose of clearing corruption in public office or community and enhancement of integrity of officials were presented at the 19th National Assembly. The fruit of such effort is the establishment of Anti-Corruption Act what is called ‘Kim Young-ran Act’. The Act is to ensure a fair performance of office and the confidence in the public institutions by prohibiting illegal solicitation or reception of bribes of public officials and civil servants. As though it is fully convinced of the validity of the legislative purpose, the Anti-Corruption Act is facing criticism that the Act is unconstitutional and contains quite a lot of unconstitutional contents because of hasty legislation. In this paper, I reviewed the unconstitutionality of the Act on various constitutional point of view. I demonstrated the unconstitutional components of the Act largely in three aspects, 1) in terms of the Penal Code of the constitutional state, 2) in terms of the principle of equality, and 3) in terms of the principle of proportionality. I do not think that it is a desirable form in the constitutional nation aiming for constitutionalism to leave the law contrary to the Constitution by emphasizing only the validity of the legislative purpose. The National Assembly needs to amend the Act constitutionally as soon as possible after sufficiently reviewing unconstitutional elements of the Act.
